Terms of Service
Terms of Service (Terms) govern your use of [spry.co.nz] (Site) and any purchase you make from Spry (we, us, our). By visiting the Site or buying from us, you agree to these Terms. If you don't agree, please don't use the Site.
These Terms are governed by the laws of New Zealand. The courts of New Zealand have exclusive jurisdiction over any dispute arising under them.

Spry is a registered trading name of Hale Limited, a company registered in New Zealand. Our registered address is 8 Rutherford Road, RD2, Mosgiel, Otago, New Zealand. NZBN: 9429053493453.
Our store is hosted on Shopify Inc., which provides our e-commerce platform. References to the Site include all pages and tools available at [spry.co.nz].
Eligibility
You must be at least 18 years old, or the age of majority in your place of residence (whichever is higher), to purchase from us. By placing an order, you confirm that you meet this requirement. You may not use our products for any unlawful purpose.
Products and pricing
We take care to display our products and prices accurately, but we can't guarantee that every description, image, or price is error-free. We reserve the right to correct errors and to change prices at any time without notice. An order confirmation from us doesn't guarantee that a price listed in error will be honoured.
Certain products may only be available online and in limited quantities. We reserve the right to limit quantities sold to any person or household.
We don't warrant that any product will meet your expectations or that errors on the Site will be corrected — but if something's gone sideways, tell us and we'll sort it. Nothing in this section limits your rights under the Consumer Guarantees Act 1993 (see Disclaimer and Limitation of Liability, below).
We take care to ensure that our product descriptions, ingredient information, and any claims we make comply with the Fair Trading Act 1986 and the ASA Therapeutic and Health Advertising Code. If you think anything on our Site is misleading or inaccurate, let us know at info@spry.co.nz.
Orders and payment
When you place an order, you're making an offer to purchase. We accept your offer when we send you an order confirmation email. We reserve the right to refuse or cancel any order at any time, including after confirmation, if we suspect fraud, an unusual volume of orders, or an error in pricing or product description.
We use Shopify's payment infrastructure. Card information is always encrypted during transmission. We don't store your card details.
You agree to provide accurate and current billing and account information and to update it promptly if it changes.
Accuracy of information
The content on our Site is provided for general information only. We update it regularly but can't guarantee it's always accurate or current. Don't rely solely on Site content when making a purchasing decision — if you're unsure about anything, ask us.
Third-party links and tools
Our Site may contain links to third-party websites or services. We're not responsible for the content, accuracy, or practices of those sites. Any dealings you have with third parties are between you and them.
We may provide access to optional third-party tools. These are provided "as is" without warranty. Your use of them is at your own risk.
User content and feedback
If you submit reviews, ideas, or other feedback to us, you grant us a non-exclusive, royalty-free licence to use, edit, publish, and distribute that content for any purpose. We're not obliged to keep your feedback confidential or to compensate you for it.
You must not submit content that's unlawful, defamatory, offensive, or that infringes another person's rights.
Prohibited uses
You must not use the Site or its content to:
• do anything unlawful or in breach of any applicable law
• transmit viruses, malware, or other harmful code
• collect personal information about others without their consent
• make false or misleading representations
• interfere with or disrupt the Site or its security
• use, copy, or reproduce any content on the Site for any purpose other than the genuine review, selection, and purchase of our products
We may terminate your access to the Site immediately if you breach these restrictions.
Disclaimer and limitation of liability
To the fullest extent permitted by law, the Site and all products and services are provided "as is" and "as available" without any warranties, express or implied — including warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the maximum extent permitted by law, Spry is not liable for any indirect, incidental, special, or consequential loss or damage arising from your use of the Site or any products, even if we've been advised of the possibility of such loss.
Nothing in these Terms limits any liability that cannot be excluded under New Zealand law, including under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.
Indemnification
You agree to indemnify and hold Spry, its directors, employees, and agents harmless from any claim, demand, or expense (including legal fees) arising from your breach of these Terms or your violation of any law or the rights of a third party.
Changes to these Terms
We may update these Terms at any time by posting a revised version on this page. The revised Terms take effect immediately on posting. Your continued use of the Site after we post changes means you accept them.
Severability and entire agreement
If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force. These Terms, together with our other policies on this page, constitute the entire agreement between you and Spry in relation to your use of the Site.
