Privacy Policy

This Privacy Policy explains how Spry collects, uses, stores, and discloses your personal information when you visit [spry.co.nz] or buy from us. It's designed to comply with the New Zealand Privacy Act 2020, including the Privacy Amendment Act 2025, which introduces new obligations around indirect collection of personal information, effective 1 May 2026.

By using the Site, you consent to the practices described in this policy.

What personal information we collect

Information you give us directly

When you place an order or create an account, we collect: your name, billing and delivery address, email address, phone number, and payment information (processed securely through Shopify — we don't store your card details). If you respond to a survey, we collect your response.

When you contact us for support, we collect the information you include in your message.

Information collected automatically

When you visit the Site, we automatically collect your IP address, browser type and version, time zone, pages viewed, search terms, and how you interact with the Site. This is collected via cookies, log files, and web beacons (see Cookies, below).

Information collected from third parties (indirect collection)

We also receive information about you from third-party services, including advertising platforms (Google, Meta/Facebook), analytics tools (Google Analytics), our email marketing platform (Klaviyo), and our e-commerce platform (Shopify). This may include data about your browsing behaviour, demographics, and interests used for marketing purposes.

From 1 May 2026, under new IPP 3A of the Privacy Act 2020, we're required to take reasonable steps to tell you when we collect your personal information from a source other than you. Where we receive your information from a third party, and it's practicable to do so, we'll notify you by updating this policy and, where appropriate, by direct communication.

Why we collect your information

We use your personal information to:

•            process and fulfil your orders, including arranging delivery
•            process payments and detect fraud
•            communicate with you about your orders and our products
•            provide customer support
•            send you marketing emails where you've consented (unsubscribe any time)
•            analyse how the Site is used so we can improve it
•            comply with our legal obligations

We won't use your personal information for purposes incompatible with those listed above without your consent.

Who we share your information with

We share your personal information with service providers who help us run our business, including:

•            Shopify Inc., our e-commerce and payments platform (see shopify.com/legal/privacy)
•            Klaviyo, our email and SMS marketing platform
•            our courier/logistics provider, for delivery
•            Google, for analytics and advertising (see policies.google.com/privacy)
•            Meta (Facebook/Instagram)
•            TikTok

We require all service providers to handle your information in accordance with applicable privacy law. We don't sell your personal information to third parties.

We may also disclose your information where required by law, in response to a valid legal request, or to protect our rights.

If we share personal information with service providers outside New Zealand, we take reasonable steps to ensure it receives comparable protection to that required under the Privacy Act 2020.

Your rights

Under the Privacy Act 2020, you have the right to:
•            request access to the personal information we hold about you
•            ask us to correct any inaccurate or incomplete information
•            ask us to delete your information (subject to any legal obligations we have to retain it)
•            withdraw your consent to marketing at any time

If you're not satisfied with how we handle your personal information, you can contact the Office of the Privacy Commissioner at privacy.org.nz.

Cookies

Cookies are small text files stored on your device when you visit our Site. We use them to:
•            keep your shopping cart and session active
•            remember your preferences
•            analyse how our Site is used
•            deliver targeted advertising

Behavioural advertising

We use your information to show you advertising we think may be relevant to you, based on your browsing behaviour and purchase history. We share some of this data with our advertising partners directly and through cookies.

Data retention and security

We keep your personal information for as long as necessary to fulfil the purposes described in this policy, or as required by law. We take reasonable technical and organisational steps to protect your information from loss, unauthorised access, or disclosure. However, no internet transmission is completely secure.

Do Not Track

We don't change our data collection practices in response to "Do Not Track" signals, as there's no consistent industry standard for how to respond to them.

Changes to this policy

We may update this Privacy Policy from time to time. We'll post the revised version on this page with an updated date. Where changes are material, we'll take reasonable steps to notify you.
